Terms of Service

These Terms of Service ("Terms") govern your use of the GoMedPay website at www.gomedpay.co.za ("Website") and the revenue cycle management advisory services ("Services") offered by Andile Memela CA(SA) CIA, trading as GoMedPay ("GoMedPay", "we", "us"). By accessing the Website or submitting a service inquiry, you agree to these Terms.

1. Nature of services

GoMedPay provides revenue cycle management advisory, claims recovery analysis, and practice billing compliance services to South African private medical practices. Our services include but are not limited to:

  • Practice revenue assessments and unpaid claims reviews
  • Identification and recovery of short-paid, rejected, or unbilled claims
  • Compliance review against Regulation 6 of the Medical Schemes Act Regulations
  • RCM training, educational content, and free practice resources

GoMedPay is not a law firm and does not provide legal advice. GoMedPay is not a medical aid administrator and does not submit claims on behalf of practices without a formal engagement agreement.

2. No guarantee of outcomes

Any projected recovery range or revenue gap estimate provided by GoMedPay — whether in a practice assessment PDF, on the website, or in verbal or written communications — is an estimate based on the information you provided and industry benchmarks. It is not a guarantee of the actual amount that will be recovered. Results depend on factors outside GoMedPay's control, including the completeness of your billing records, the response of medical aids, and the age of outstanding claims.

3. Website use

You may use the GoMedPay website for lawful purposes only. You must not:

  • Attempt to gain unauthorised access to any part of the Website or its infrastructure
  • Use automated tools to scrape, harvest, or copy Website content without written permission
  • Submit false or misleading information in any inquiry or subscription form
  • Use the Website in any way that violates South African law

4. Intellectual property

All content on the GoMedPay website — including articles, templates, assessment reports, design elements, and educational resources — is the intellectual property of GoMedPay and is protected by South African copyright law. Free downloadable resources are licensed for personal use by the downloading practice only. Redistribution, resale, or republication without written permission is not permitted.

5. Limitation of liability

To the maximum extent permitted by South African law, GoMedPay's total liability to you for any claim arising from use of the Website or Services shall not exceed the amount you paid to GoMedPay in the twelve months preceding the event giving rise to the claim.

GoMedPay shall not be liable for any indirect, incidental, or consequential losses, including loss of revenue, loss of data, or loss of business opportunity, arising from reliance on Website content or assessment estimates.

6. Confidentiality

GoMedPay treats all practice-specific information submitted through inquiry forms as confidential. We do not share practice financial details, patient billing information, or practice names with third parties except as described in our Privacy Policy. Clients of GoMedPay's paid services are subject to a separate confidentiality and Data Processing Agreement.

7. Data protection

GoMedPay processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Please read our Privacy Policy and POPIA Compliance Statement for full details.

8. Third-party links

The GoMedPay website may contain links to third-party websites (including SAICA, the Information Regulator, and the Medical Schemes Act regulations). We do not endorse and are not responsible for the content or privacy practices of those sites.

9. Changes to these terms

We reserve the right to update these Terms at any time. Material changes will be reflected in an updated effective date. Your continued use of the Website after such changes constitutes your acceptance of the revised Terms.

10. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
